Ms K suffered a blow to the head when a colleague who was moving a metal cage collided into her. Even though the accident occurred as a result of the employee’s negligence, a claim was made directly against Amazon under the principle of vicarious liability. The principle of vicarious liability allows claimants to hold employers legally responsible for acts and/or omissions of their employees. Liability for the accident was admitted at an early stage by Amazon.
Ms K’s injuries were complex in nature. She complained of headaches and vomiting, symptoms related to concussion, so Eduardo acted promptly to instruct a consultant neurologist in order to assess the claimant’s head injuries. Following her review with the consultant neurologist, Ms K complained of tinnitus, which required further examination by an ENT Surgeon. It was determined that the Tinnitus would be permanent but manageable.
